Terms & Conditions

Effective Date: August 14, 2026 • Daybreak Afrika Technologies

By registering an account, utilizing the NiNCheck dashboard, or integrating our enterprise GraphQL/REST APIs, you agree to be bound by these Terms & Conditions and all applicable statutory regulations of the Federal Republic of Nigeria.

1. Introduction & Scope of Service

NiNCheck is an enterprise identity verification platform and utility vending terminal operated by Daybreak Afrika Technologies ("Company", "we", "us", or "our"). These Terms & Conditions ("Terms") govern access to and usage of our verification infrastructure, API endpoints, web portals, wallet services, and digital utilities by registered clients, enterprise partners, and authorized agents ("User", "Client", or "You").

2. Account Registration & User Verification

To access identity verification services, Clients must register an account and undergo mandatory account profiling. You agree to:

  • Provide accurate, complete, and up-to-date corporate and personal information.
  • Maintain the confidentiality of your account credentials, passwords, and API secret tokens.
  • Notify NiNCheck immediately upon discovering any breach of security or unauthorized access.
  • Ensure that all operational personnel utilizing your portal adhere strictly to these Terms.

3. Identity Verification & Statutory Consent Policy

Identity verification lookups (including National Identity Number [NIN], Virtual NIN [vNIN], Tax Identification Number [TIN], CAC Corporate Records, International Passport, Driver's License, and Voter VIN) must be conducted in strict compliance with statutory regulations:

  • Lawful Consent: You warrant that explicit, verifiable consent has been obtained from the data subject prior to initiating any identity lookup.
  • Permissible Purpose: Verification queries must serve a legitimate business purpose such as customer onboarding (KYC), fraud prevention, employment screening, credit assessment, or legal compliance under CBN and SEC guidelines.
  • Prohibited Lookups: Unlawful surveillance, unauthorized background checks, data scraping, or re-selling of raw identity records is strictly forbidden and grounds for immediate account termination.

4. Data Privacy & NDPA / NDPR Compliance

NiNCheck is committed to processing data in compliance with the Nigeria Data Protection Act (NDPA 2023) and the Nigeria Data Protection Regulation (NDPR):

  • All data transmitted between Client applications and NiNCheck servers is encrypted using TLS 1.3 encryption.
  • Raw biometric template data is never stored on NiNCheck servers; lookups are evaluated against government databases in real-time.
  • Verification audit logs are retained solely for regulatory accountability, dispute resolution, and security compliance.

5. API Usage, SLAs & Service Availability

Enterprise API clients receive access keys subject to rate limits and operational guidelines:

  • Service Availability: We target 99.9% platform availability. However, service availability relies on upstream official registries (NIMC, CAC, FIRS, NIS, INEC, FRSC).
  • Rate Limits: API clients must conform to rate limits specified in their enterprise onboarding agreement. Excessive automated polling may result in temporary IP throttling.
  • Maintenance Windows: Scheduled system maintenance will be communicated with prior notice via email and administrative status notifications.

6. Wallet Funding, Billing & Refund Policy

NiNCheck operates on a prepaid unit wallet and cash wallet credit system:

  • Prepaid Deposits: Funds deposited into user wallets are dedicated for identity lookups, API queries, and product vending.
  • Non-Refundable Query Fees: Completed verification queries that successfully return status or valid data responses from upstream registries are non-refundable.
  • Failed Transactions: If a query fails due to system error or server timeout before reaching the upstream authority, charged credits are automatically refunded to the user wallet.
  • Dispute Resolution: Billing discrepancies must be reported to support@nincheck.com within 7 business days of transaction occurrence.

7. Prohibited Conduct & AML Compliance

Users shall not engage in:

  • Attempting to probe, scan, reverse-engineer, or breach security controls of the NiNCheck portal or GraphQL backend.
  • Using the platform to facilitate money laundering, terror financing, or fraudulent transactions.
  • Sharing API keys or administrative account access with unauthorized third parties.

8. Intellectual Property

All software, GraphQL schemas, database models, user interface designs, logos, and documentation associated with NiNCheck remain the exclusive intellectual property of Daybreak Afrika Technologies. No license or ownership right is granted except for the limited permission to access services under these Terms.

9. Limitation of Liability & Disclaimers

To the maximum extent permitted by applicable law, Daybreak Afrika Technologies shall not be liable for any indirect, incidental, special, or consequential damages resulting from upstream government registry outages, data inaccuracies provided by statutory databases, or temporary service interruptions.

10. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any dispute arising out of or in connection with these Terms shall first be resolved through good-faith mutual negotiation. If unresolved within 30 days, the dispute shall be submitted to binding arbitration under the Arbitration and Mediation Act of Nigeria.
